1. General Use of Website & Services

• 1.1 By using our website or placing an order, you agree to comply with these Terms.
• 1.2 FunkyStickables reserves the right to update or modify these Terms at any time without notice. Continued use of our services constitutes acceptance of the revised Terms.
• 1.3 All prices are in Australian Dollars (AUD) and inclusive of GST (if applicable), unless otherwise stated.

2. Customer Uploads & Intellectual Property

• You are the legal owner of the Content or you have obtained all necessary permissions and rights to reproduce, print, and distribute the Content.
• You accept full responsibility for any legal issues that may arise from the Content you upload.

FunkyStickables does not claim ownership of your uploaded Content. We act solely as a print service provider, producing physical stickers based on the files you supply.

You agree that FunkyStickables:

• Is not liable for any copyright, trademark, or intellectual property disputes arising from your Content.
• May refuse or cancel an order at any stage if we reasonably suspect the Content infringes third-party rights.

3. Order Process & Proofs

• 3.1 Orders are final once placed. If a design proof is provided, it is your responsibility to check all details (size, colours, spelling, layout).
• 3.2 Where no approval is received within [X days], FunkyStickables may treat the proof as approved and proceed with production.
• 3.3 Orders may not be cancelled once production has commenced. Cancellations prior to production may incur fees.

4. Production & Delivery

• 4.1 Production times are estimates only and commence after payment and (if applicable) proof approval.
• 4.2 FunkyStickables is not responsible for delays caused by shipping providers, customs, or events beyond our control.
• 4.3 Risk in the goods passes to you upon dispatch.

5. Returns, Refunds & Replacements

• 5.1 Due to the custom nature of our products, we do not offer refunds or returns for change-of-mind, incorrect orders, or customer errors in artwork.
• 5.2 If your order is defective or damaged, you must notify us within 7 days of delivery with photo evidence.
• 5.3 At our discretion, FunkyStickables will replace defective items or issue store credit. Cash refunds are not available unless required by law.

6. Limitation of Liability

• 6.1 To the maximum extent permitted by law, FunkyStickables excludes all liability for any loss, damage, or claim arising from:
  • Use of our website or services.
  • Content provided by customers.
  • Delays in production or delivery.
• 6.2 Where liability cannot be excluded under Australian Consumer Law, our liability is limited to the replacement or re-supply of the goods ordered.

7. Privacy & Data

• 7.1 We collect personal information such as name, email, address, and payment details for the purpose of fulfilling your order.
• 7.2 We do not sell or share personal data with third parties, except as required to process your order (e.g. shipping carriers, payment gateways).
• 7.3 By using our website, you consent to our use of cookies and analytics tools for performance and marketing purposes.

8. Right to Refuse Service

• 8.1 FunkyStickables reserves the right to refuse, cancel, or suspend any order at our discretion, including but not limited to suspected intellectual property infringements, abusive behaviour, or fraudulent activity.

9. Governing Law

• 9.1 These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in Queensland.
